JUDGEMENT

(1.) In Criminal case No. 177/2 of 1954 Shri M.L. Khanna, Magistrate, convicted Ratna, aged 13 years under Section 381 of the Indian Penal Code and sentenced him to suffer rigorous imprisonment for six months.

(2.) Finding that Ratna was a youthful offender the Magistrate has ordered that Ratna shall instead of undergoing the sentence imposed upon him be sent to the Reformatory School for a period for four years.

(3.) Rule 3 made under Section 8(3)(b) of the Reformatory Schools Act, 1897 , provides -
