IT may be mentioned here that during the pendency of the proceedings out of which the present appeal has arisen another identical application under Section 5 of the Act, was made by the judgment -debtor before the Tribunal at Patiala, While arguing the appeal before the learned Single Judge the parties agreed that this application be taken into consideration in order to avoid further litigation and delay in the decision of the case.
