JUDGEMENT

(1.) On the evidence produced against him and this plea of guilty, the petitioner, who according to the learned trial magistrate is a boy of 9 or 10 years of age and a first offender, was found guilty under sections 454 and 511 of the Indian Penal Code and instead of being sentenced to any punishment straight away was directed to be released on his entering into a bond with one surety in the sum of Rs. 500/- to appear and receive sentence when called upon during the period of two years and in the meantime to keep peace and to be of good behaviour. He has come up in revision against his conviction and the direction that the learned trial magistrate gave in regard to the execution of the bond as stated above.

(2.) On 9.11.1954, Mukat Batt, who is a chaukidar of Chamri Quarters saw four boys opening the lock of quarter No. 1 on the ground floor in block No. 8. He went towards them. On seeing him the boys ran away and the block was found open. He chased the boys and caught Manjit Singh and Surinder Singh. The other two boys Navin Kumar petitioner and Satish Kumar ran away. It seems that Surrinder Singh and Manjit Singh gave the names of Navin Kumar and Satish Kumar. Navin Kumar was arrested by Shri Ram Piara Head Constable and the key with which the lock of the quarter had been opened was recovered from him. These four boys were sent up for trial and the petitioner alone was convicted on the evidence of Mukat Batt and Ram Piara Head Constable and on this own plea of guilty before the trial magistrate.

(3.) The petitioner was undefended by a counsel and in view of his age his plea has little effect on his guilt.
