JUDGEMENT

(1.) Instant petition has been fileed by the petitioner under Articles 226 and 227 of the Constitution of India for quashing order dtd. 2/7/2024 (Annexure -3). Further prayer has been made for directing thhe respondents to release the retiral and all consequential benefits to the petitioner.

Learned State counsel has produced communication dtd. 26/11/2025 from the District Food Supplyy Controller, Department of Food Civil Supplies and Consumer Affairs, Bathinda, Punjab, addressed to the Advocate General, Punjabb, wherein it has been stated that the pettitioner was dismissed from service on 13/11/1992 and the said order of dismissal has been upheldd upto this Court in RSA No.4291 of 1999. It has further been submmitted that self-declaration is required to be submitted by the dismissed employee for claiming GPF amount andd this self-declaration has been submitted by the petitioner on 7/9/2013 and thereafter, the deparrtment had sanctioned the amount of Rs.1,69,385.00 with interest vide order dtd. 17/2/2014 and GPF amounnt was submitted by the concerneed bill branch to the treasury office, Bathhinda on 17/4/2014 and paymment has been made to the petitioner on 7/5/2014 which contains interest upto 30/6/2010, which was actual date of retirement of thee petitioner had he not been dismissed frrom service in the year 1992.

(3.) In view of the stand taken by the respondents, learned counsel for the petitioner wishes to withddraw the present petition to avail other legal remedy in accordance with law.
