JUDGEMENT

(1.) The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking a writ of certiorari for quashing advertisement dtd. 29/7/2019 (Annexure P-18) issued by respondent No.2 whereby applications have been invited for recruitment to non-teaching posts on regular basis even though the selection of the petitioners was through proper channel and they are in continuous service for more than 10 years and the respondents are not considering their case for regularization.

(2.) Learned counsel for respondents No.2 and 3 submits that the instant petition has been rendered infructuous as the advertisement dtd. 29/7/2019 (Annexure P-18) has already been cancelled during pendency of the present petition and the services of the petitioners have been regularized. One such regularization order of petitioner No.3 has been produced in the Court which is taken on record subject to all just exceptions.

(3.) Learned senior counsel for the petitioners submits that although the services of the petitioners have been regularized, however, the same have been regularized prospectively whereas the same ought to have been regularized from the earlier date. He seeks permission to withdraw the present petition with liberty to make a detailed representation to the respondents for redressal of the said grievance.
