JUDGEMENT

(1.) Petitioner (Aman Kumar) has filed the instant writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of certiorari for setting aside the order dtd. 23/2/2023 (Annexure P-4) passed by the learned Collector, Panipat, appointing respondent No.3-Sumit Kumar, as the Chowkidar of Village Dumiyana, Tehsil Madlauda, District Panipat.

(2.) Briefly, on retirement of one Ganga Dutt S/o Tej Ram, previous Chowkidar of Village Dumiyana, proceedings were initiated for filling up the vacancy. In pursuance of the proclamation made in the village, three candidates (including the petitioner and respondent No.3) applied for the afore-said post. It appears that one of the candidates namely, Rohtas s/o Mamraj, withdrew his candidature and ultimately, only two candidates i.e. the petitioner and respondent No.3 were left in the fray.
