(1.) Petitioner has approached this Court by way of instant petition under Section 482 of the Code of Criminal Procedure (for short 'Cr.P.C.') invoking its inherent jurisdiction for quashing of FIR No.50 dated 1.4.2012 registered under Sections 279 and 304-A of the Indian Penal Code ('IPC' for short) at Police Station Sadar Patiala, District Patiala and the consequential proceedings arising therefrom, on the basis of compromise (Annexure P-2). Notice of motion was issued.
(2.) In compliance of the order dated 28.9.2015 passed by this Court, the parties got their statements recorded before the learned trial court. Consequently, report dated 7.10.2015 sent by the learned Additional Chief Judicial Magistrate, Patiala has been received which is available on record of the case along with the statements of the parties. Learned Magistrate has reported that the parties have made their statements voluntarily and without any pressure. The compromise arrived at between the parties has been found to be a genuine one.
(3.) Learned counsel for the petitioner submits that the parties have decided to bury the hatchet and are living peacefully. He further submits that continuation of the impugned FIR and subsequent criminal proceedings arising therefrom, are liable to be quashed in the interest of justice.
