(1.) In this case, five persons were apprehended from a TATA Safari bearing registration No.PB-10F-1218 and 3 Kg. opium was recovered. Learned counsel for the petitioner contends that the petitioner belongs to Hanumangarh and had taken lift in the said TATA Safari. However, at this stage, there is no evidence to the effect that the petitioner had taken lift. The recovery is commercial. Therefore, at this stage, there is no ground to believe that the petitioner was merely a passenger. However, keeping in view the fact that the recovery is effected from one person and five persons were shown to be present in the said TATA Safari and all of them were apprehended, petition is disposed of with liberty to the petitioner to move a representation before the Senior Superintendent of Police, Barnala, who shall get the inquiry conducted into the FIR No.66, dated 30.07.2014, under Sections 18 and 29 of the Narcotic Drugs and Psychotropic Sustances Act, 1985, registered at Police Station Tapa Mandi, District Barnala from an officer of the rank of Superintendent of Police, to find out as to whether one or all the persons were involved in the crime and take action accordingly. The inquiry shall be completed within two months.
