JUDGEMENT

(1.) Prayer in the instant petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in FIR No. 305 dated 27.12.2014 registered under Sections 406/420 of the Indian Penal Code at Police Station Chhappar, District Yamuna Nagar.

(2.) As per version of the prosecution, complainant-Tarsem S/o Sh. Prem Chand and his friend Satish Kumar went to the shop of petitioner who is a travel agent. The petitioner told the aforesaid persons that his elder brother, namely; Sandeep is settled in Cyprus for about 5 years and that their work permit with assurance of monthly salary @ Rs. 80,000-90,000/- can be obtained. The petitioner also told them that the employment would include four holidays in a month with extra payment for the overtime work. The petitioner further told them that they would have to incur an expenditure of Rs. 5,30,000/- with an amount of Rs. 50,000/- for the work to be done by the petitioner. After 07 days, petitioner rang up the complainant and called both these persons to bring amount of Rs. 80,000/-. The petitioner got purchased the air tickets for them to Dubai and the Visa. The complainant and his friend were called in the premises of Saini Tours and Travels, Babain and they boarded the flight on 04.07.2014. They were also handed over a ceman book each and Visa for Dubai and told by the petitioner to conceal that ceman book. On reaching Dubai, the complainant and his friend talked to petitioner telephonically and the petitioner gave them telephone number of a Pakistani Agent and they were told to pay 1600 Euros to the said agent at Dubai. The complainant and his friend were given the work permit of Northern Cyprus and they were told to destroy their tourist Visa of Dubai. Then they reached Istanbul where they were again told to tear off work permit and advised to take out the ceman book. They reached Earcan Airport in Cyprus and due to fake forms, the complainant was detained and deported back to India.

(3.) I have heard learned counsel for the petitioner, learned State counsel and carefully perused the paper book.
