(1.) HEARD .

(2.) IT is not disputed that no sanction for prosecution of the petitioner has been granted. The trial court, however, sought to proceed with the case on the ground that cognizance had already been taken.

(3.) ACCORDINGLY , this petition is allowed and the impugned order framing charge against the petitioner under Sections 7/13(2) of the Act, is set aside. Petition allowed.
