JUDGEMENT

(1.) The husband is aggrieved against the judgment and decree passed by the learned trial Court dissolving the marriage on a petition seeking dissolution of marriage filed by the wife.

(2.) The marriage between the parties was solemnized on 20.3.1976. Out of wedlock, two children were born. It is the case of the wife that their relations remained cordial for a period of two years. Therefore, they remained together as husband and wife but their relations were not cordial. It is the allegation of the wife that she has been turned out of the house in three clothes and in spite of repeated attempts for reconciliation made by the Panchayat, the husband did not agree to keep the wife in the matrimonial home. It is, thus, alleged that the husband has treated the wife with cruelty and sought dissolution of marriage.

(3.) In written statement, it was the stand of the husband that he never demanded any dowry and the wife had illicit relations with one Amrik Singh son of Chanan Singh. The wife went missing when she had gone to Ludhiana to receive treatment after she fell down from the staircase. The wife came back to the matrimonial home on 17.7.1996 when she admitted that she would live with her family. On 17.7.1996, wife as well as Amrik Singh had given in writing admitting their mistake.
