(1.) Writ petition admitted. Respondents are represented by Mr. Kamal Sharma, Addl. A.G., Haryana. Pleadings are complete. By consent, petition placed on board and called out for hearing.
(2.) The petitioner seeks employment on compassionate grounds. His father Ram Parshad, was working as a driver with the second respondent. He died in harness on August 20, 1977. At the time of the death of his father Ram Parshad, the petitioner was a minor. Now the petitioner and his mother have made applications, Annexures P. 2 and P. 3 respectively seeking employment on compassionate grounds which are consistent with the Government Policy. Respondents Nos. 1 and 2 have filed a written statement through the Establishment Officer, Transport Department. They have shown their willingness to accommodate the petitioner and the same is reflected in paragraphs 4,5 and 6 of the written statement. It appears from the written statement that the petitioner will be accommodated as a Clerk, as proposed by the General Manager, Haryana Roadways, Kaithal. It is urged on behalf of the petitioner by Mr. Thakur, that since the petitioner is a diploma holder in civil engineering, he may be accommodated on a technical post, namely, Junior Engineer. In our opinion, it is not possible to give direction to the respondents to accommodate the petitioner as a Junior Engineer since the petitioner's father was employed with the second respondent as a driver. However, if the petitioner is a diploma holder in civil engineering, talent may not be wasted in a clerical job and he may be given such job in clerical cadre where he may have future prospects to get entry into the engineering department.
(3.) Writ petition to stand disposed of with the direction to the respondents to act in terms of the statement contained in paragraphs 4,5 and 6 of the written statement. No order as to costs.
