JUDGEMENT

(1.) The petitioner had appeared in 10+2 Examination in March, 1992. However the result of the said examination was not declared by the respondent-Board for the reason that the petition was placed in compartment in 10+2 Examination and according to Rule, only two chances for clearing the compartment could be given. However, the school in which the petitioner was pursuing her studies had given the petitioner 3rd chance which was not permissible under the Rules.

(2.) The Counsel for the petitioner contends that the petitioner had successfully cleared 10+1 Examination. As such the result of the petitioner of 10+2 Examination cannot be withheld. However, the learned Counsel appearing for the Board contends that the result of the petitioner could not be declared as 3rd chance to the petitioner for clearing 10+1 examination was wrongly given by the school.

After having considered the submission of the counsel for the parties and perusing the paper-book, I am of the considered view that once the Education Board had allowed the petitioner to appear in 10+2 Examination and the petitioner had successfully cleared the compartment also, there is no justification in not declaring the petitioner's result of 10+2 Examination. Without going into the merit of the case, I choose to have a compassionate view of the matter, since the career of a young student is involved, the respondent-Board is directed to declare the petitioner's result of 10+2 Examination forthwith.
