BALBIR SINGH Vs. STATE BANK OF INDIA

Decided On October 24, 1994
BALBIR SINGH Appellant
V/S
STATE BANK OF INDIA Respondents

JUDGEMENT

(1.) The petitioner was working as clerk in the State Bank of India at Khanna, district Ludhiana. He was transferred to Gubhaya, district Ferozepur. The petitioner made a representation, in which apart from other grievances put forward by him which are not relevant for the present purposes, has made a request that he may be considered for transfer to Rajpura. The representation was disposed of by Memo. Annexure P.2 dated July 7, 1993, in which it was stated as under :-

(2.) The portion extracted from Annexure P.2 is only to the effect that the petitioner's request for transfer to Rajpura will be considered sympathetically as and when the opportunity arises. This, in our view, does not amount to any promise that the petitioner will be transferred to Rajpura. We have no reason to hold that the transfer to Gubhaya is by way of punishment. It has been brought to our notice that the aforesaid transfer is contravention of any rule of the bank applicable to the petitioner. There is no case for invoking the extraordinary jurisdiction of this Court. The petition is dismissed in limine.
