Kamaljot Kaur through present petition filed by her under Articles 226/227 of the Constitution of India seeks writ in the nature of mandamus directing the respondents to give her admission in B.Sc. (Agriculture) either at College of Agriculture. Ludhiana by way of her first preference or at College of Agriculture at Faridkot.

The facts of the case reveal that petitioner passed her Matriculation examination in the year 1991 by securing 69% marks and then passed her plus 2 examination from Government Senior Secondary School, Ludhiana in the year 1993 securing 55% marks in Science group. Since she was interested in doing B.Sc. (Agriculture), she appeared in the Combined Entrance Test held at Ludhiana on 29.7.1993. Her name appeared in the list of successful candidates at Sr. No. 132. Inasmuch as there were less seats, she was placed in the waiting list at Sr. No. 14, It is pleaded that there were 90 seats for B.Sc. (Agriculture) at the College of Agriculture, Ludhiana and 40 seats at the College of Agriculture, Faridkot. Both the Colleges aforesaid are affiliated to the Punjab Agricultural University, Ludhiana and the manner of admission in both the Colleges is same. On October 4, 1993 petitioner received a letter from the office of the Registrar, Punjab Agricultural University, Ludhiana asking her to appear before the Dean, College of Agriculture, Faridkot on October 6, 1993, as a few seats in B. Sc. (Agri.) were lying vacant there. It is pleaded that similar letters were issued to 14 other candidates according to their serial numbers in the waiting list. Out of 15 candidates, to whom the letters were issued, only seven appeared before the Dean, College of Agriculture, Faridkot on October 6, 1993. The candidates, who were at serial Nos. 1,4,5,6,10,12 and 14 were medically examined. However only one candidate out of aforesaid seven was allowed to deposit fee etc. and remaining candidates including petitioner were denied admission verbally.
(3.) Learned counsel for the petitioner, on the facts stated above, urges that inasmuch as there were eleven seats vacant in B.Sc. (Agri.) at college of Agriculture, Ludhiana and petitioner, who fulfils all qualifications and had cleared the Entrance Test, could not be denied admission.
