JUDGEMENT

(1.) The matter here concerns selection of police constables for the lower school course.

(2.) The relevant provisions governing the selection of constables for the lower school course is rule 13.7 of the Punjab Police Rules, 1934 , as applicable to the State of Haryana (hereinafter referred to as the Rules). This rule requires the Superintendent of Police to maintain a list known as 'list B' containing names of all constables selected for the said course. The rule further provides, "Names shall be entered in the list in the order of merit, determinated by the Departmental Promotion Committee on the basis of tests in (i) Parade (ii) written test in general law (Indian Penal Code, Criminal Procedure Code, Indian Evidence Act and such other Local and Special Laws as may be specified (iii) interview and (iv) examination of Services Record."

(3.) For the purposes of this rule 13.7, by sub rule 3 thereof, the Departmental Promotion Committee in each district comprises, "District Superintendent of Police and two Deputy Superintendents of Police, to be named by the D.I.G. concerned. "The rule as it stood at the relevant time also contained the proviso that, "no constable shall be considered eligible for lower school course until the entry of his name in the list has been approved by the D.I.G. of the Range."
