(1.) This order will dispose of Civil Writ Petition Nos.12333 and 12553 of 1994 as the point involved in both the petitions is common. Facts have been noticed from C.W.P. No.12333 of 1994.

Petitioner passed his Bachelor of Arts Examination held in April, 1989 from Guru Nanak Dev University, Amritsar (for short 'the GND University') under the old scheme 10 + 1 + 3 by obtaining 42% marks. The Government of Punjab issued a notification dated April 28,1994 notifying that admission to the B.Ed, course for the session 1994-95 in the Educational Colleges situated in the State of Punjab and the Union Territory, Chandigarh and affiliated to the GND University Amritsar, Panjab University, Chandigarh and Panjabi University, Patiala shall be made on the basis of competitive entrance test. It was also notified that a Joint Entrance Test shall be conducted by the GND University for all the colleges. The petitioner, being eligible was allowed to appear in the said Joint Entrance Test held on June 26, 1994. Annexure P-2 is the result-card of the petitioners. He secured 105.50 marks out of a total of 250 marks. He, on the strength of his result was eligible to seek admission to the course being a Scheduled Caste Candidate.
(3.) The petitioner on the strength of his result in the Joint Entrance Test applied for admission to the course in Ramgarhia College of Education, Phagwara. Interview for admission was held on August 17, 1994. The petitioner was denied admission though the candidates of his category and lower in merit than him had been granted admission. Denial of admission has led the petitioner to file this writ petition.
