(1.) The petitioner had applied for the post of Social Study Mistress in response to the advertisement dated 16.7.1974. She was informed vide communication dated 2.2.1976, copy of which is Annexure P-3 to the writ petition, that her name had been placed in waiting list and the same had been sent to the Director, Public Instructions, Punjab, Chandigarh. According to the petitioner, despite numerous requests having been made to the respondent-Department, she had not been given regular appointment and feeling aggrieved because of inaction on the part of the respondent Department, she filed the present writ petition under Articles 226/227 of the Constitution of India, seeking direction to the respondents to offer her regular appointment.

The case of the petitioner as set up in the writ petition is that at the time of filing of the writ petition, she was working against a leave vacancy in the respondent-Department and she had apprehension that her services were likely to be terminated at any time. Thus, she filed present writ petition with a prayer that as an interim measure, her services may not be terminated.
(3.) Notice of motion was issued on 1.4.1980 by a Division Bench of this Court and meanwhile stay of termination of services of the petitioner was also granted by the Bench by way of interim relief.
