JUDGEMENT

(1.) Services of the petitioner who was working as Supervisor were regularised vide order Annexure p2 dated 14.1.94. Order Annexure p3 was passed on 1.4.94 recalling the order Annexure p2 deregularising the services of the petitioner without issuing any notice to him and affording an opportunity of hearing. Petitioner has come up in writ petition against the impugned order Annexure p3 on the plea that the order annexure p3 could not be passed without affording an opportunity of hearing to the petitioner.

The stand taken by the respondent-state in the written statement is that petitioner had consented to be regularised as Pump Operator Gr.II, which carries the same pay scale as Supervisor as the post of Supervisor in the department had become surplus. Be that as it may, we deem it appropriate that a direction be issued to the respondent-State to pass a fresh order after affording an opportunity to show cause to the petitioner while withdrawing the concession given to him regularising his services.

(3.) For the reasons stated above, we allow this writ petition, quash the impugned order annexure p3 leaving it open to the respondent-State to pass a fresh order after affording an opportunity to the petitioner to show cause. No costs. Petition allowed.
