JUDGEMENT

(1.) Petitioner, who is B. Tech. in Agricultural Engineering from the Punjab Agriculture University, Ludhiana, had applied for selection and appointment as Subject Matter specialist in respondent to an advertisement issued by the Haryana Public Service Commission (for short, 'the Commission') in February, 1988. He was interviewed by the Commission along with eight other eligible candidates, but only four candidates were selected against eleven advertised vacancies of Assistant Agriculture Engineers/Subject Matter Specialists. The petitioner challenged his non-selection in Civil Writ No. 8386 of 1988, which he filed along with Shri Amarjit Singh.

(2.) The respondent-Commissioner once again advertised seven posts of Assistant Agriculture Engineers/Subject Matter Specialists vide advertisement dated 15.10.1988. Two of these posts were reserved for Scheduled Castes and one for Backward Class. This time the petitioner was selected by the Commission and he was intimated about his selection vide letter dated 11.10.1989 (Annexure P.3) issued by the respondent-Commission. Not with appointment to the petitioner without any legal justification. The petitioner has been treated by the respondent arbitrary and has been deprived of his legitimate right without any legal authority.
