JUDGEMENT

(1.) IT has been urged by Shri R.S. Ghai, learned Senior Advocate appearing for the petitioners that as the petitioners are employed in the State Bank of India and the dispute pertained to the year 1985 and they had already undergone the agony of a protracted trial, they be granted the benefit of probation. Keeping in view the aforesaid facts, I deem it appropriate that the petitioners should be granted the benefit of probation under Section 360 of the Code of Criminal Procedure subject on the condition that they will compensate the complainant Smt. Baljeet Kaur by paying her a sum of Rs. 25,060/-, the present petition is accordingly allowed to the extent indicated above and the petitioners are directed to be released on furnishing personal bond in the sum of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of Chief Judicial Magistrate/D.M. Panipat and be bound down for a period of two years. The petitioners will be released subject to the condition that they will make the payment of Rs. 25,000/- to the complainant within a period of one month from the date of their release. In case, the aforesaid amount is not paid within the time stipulated the present petition will be deemed to have been dismissed. With the above observations, this petition stands disposed of. Petition partly allowed
