JUDGEMENT

(1.) (Oral) - As per the prosecution, on 25.4.2014, the petitioner had entered the office, where the prosecutrix was working. On finding her alone over there, he tried to rape her, which was objected to by the prosecutrix. The petitioner then gave a knife blow, which hit the prosecutrix on her right hand. He tried to give another blow with the knife in her stomach but she was able to ward of the same with her hand. On an alarm raised by the prosecutrix, Yogesh and Ajay Malik reached at the spot. On seeing them the petitioner managed to run away from there. However, while leaving, he threatened the prosecutrix that Ajay had come to the spot otherwise he would not have left her to show her face anywhere. It is also the prosecution case that the petitioner had been following the prosecutrix for the last about 11/2 years and teasing her.

(2.) Initially, the FIR was registered for the offences under Sections 323, 324, 452, 354-A and 506 Penal Code as well as Sections 376/511 Penal Code. During the investigation of the case, the police has deleted the offences under Sections 376/511 Penal Code and, instead, offence under Sec. 354-D Penal Code has been added.

(3.) The petitioner is in custody since 30.4.2014. The trial of the case is likely to take a long time. Continued detention of the petitioner in jail will not promote the ends of justice.
