JUDGEMENT

(2.) This petition is directed against the order dated 23rd July, 2014 passed by the learned Civil Judge (Junior Division), Kharar in Civil Misc. No.157 dated 23.11.2013 whereby he dismissed the application filed by the petitioner and refused to restore the original civil suit.

(3.) Brief facts of the case are that the petitioner along with respondent No.2 filed a suit for declaration against respondent No.1 to the effect that they are joint owners in possession of the dwelling house No.572 constructed on a plot measuring 9 Marlas situated in Village Mundi Kharar, District Mohali, Punjab. Further a relief of permanent injunction was prayed restraining respondent No.1 from alienating the said property or changing its nature in any manner whatsoever.
