SUDHIR KUMAR Vs. STATE OF HARYANA

JUDGEMENT

(1.) PETITIONER has approached this Court claiming promotion to the post of a Clerk from that of a Sewadar, a Class -IV post.

(2.) IT is the contention of the counsel for the petitioner that the persons junior to the petitioner, namely, Sh. Raghbir Singh and Sh. Ashok Kumar, who had been appointed on 27.12.1997 and 19.05.1998 respectively, stand promoted to the post of Clerk vide order dated 28.06.2012 (Annexure P -1). The date of joining of the petitioner is 23.12.1997, which is prior to these two persons. The case of the petitioner for promotion was sent to the office of the Director, Secondary Education, Haryana, through proper channel by the Principal, Government Senior Secondary School, Thumbad, District Ambala on 27.07.2012. No further action has been taken thereon. Faced with this situation, petitioner has served a legal notice dated 12.05.2014 (Annexure P -3) upon the respondents, which also has not solicited any response.

IN the light of the submissions made by the counsel for the petitioner and without going into the merits of the case or commenting thereon, the present writ petition is disposed of with directions to the Director General, Education, Haryana -respondent No. 2 to consider and decide the legal notice dated 12.05.2014 (Annexure P -3) served by the petitioner within a period of four months' from the date of receipt of certified copy of this order.
