JUDGEMENT

(1.) The appeal is filed by the appellant, who was an injured in a motor vehicle accident, which took place on 14.11.1992. He was awarded compensation of Rs.35,000/-, which according to the appellant, was highly inadequate.

(2.) Learned counsel for the appellant argued that nothing was awarded towards loss of income of the injured and also nothing was awarded towards disability. The injured was an agriculturist, as was clear from the documents Mark PE/1 to PE/15 but his income was assessed by the Tribunal only at something between Rs.1500/- and Rs.2000/- per month.

The income propounded by the appellant was Rs.8000/- per month in the claim petition while he said that his income was between Rs.10,000/- and Rs.12,000/- per month when he appeared in the witness box. The appellant, therefore, himself not sure as to what was his income. It cannot, thus, be said that the Tribunal made a mistake in holding that the outer limit of the income of the appellant was Rs.2000/- per month.
