JUDGEMENT

(1.) In the present appeal, challenge has been laid to the complainant to the acquittal of the accused recorded by the trial Court.

(2.) It was the case of the prosecution that when the complainant Ramesh Kumar was present along with his partner Baljit Singh at his office, one Pargat Singh arrived there on 6.9.2010 and returned a sum of Rs. 10,000/- taken by him as loan. When the said amount was lying on the table, at about 5.00 P.M. accused Sandeep Kumar entered into the office with other accused armed with weapons and broke the glasses of the office. Accused Sanjiv Kumar took away Rs. 10,000/- from the table. The complainant and Baljit Singh were confined in the office room. The accused went away with a threat to kill the complainant and his partner. A case under Sections 342, 427, 452, 379, 506 and 148 of the Indian Penal Code was registered as against the accused.

(3.) The trial Court adverting to the evidence on record found that the prosecution failed to establish the charges as against the accused and, therefore, acquitted them of the charges.
