(1.) Challenge is to the judgment dated 15.07.2014 passed by the learned Addl. Sessions Judge, Ludhiana, whereby he uphold the judgment dated 22.04.2013 passed by learned JMIC, Ludhiana holding the petitioners guilty of offences punishable under Section 420 IPC and sentenced them to undergo rigorous imprisonment substantially for a period of one year.

The complainant Raj Kaur had lodged F.I.R against the petitioners alleging that the the petitioners have not executed the sale deed even after receiving the sale consideration amount and fraudulently got signatures of the complainant on the basis of forged general power of attorney. The complainants purchased land measuring 80 sq yards situated at Haibowal, Sant Vihar, Chuharpur Road, Ludhiana and an agreement to sell was also executed and Rs.2 lacs were paid as earnest money. In spite of executing the sale deed, fraudulently, a power of attorney was given by the accused, by taking advantage of the illiteracy of the complainant. An amount of Rs.6,86,000/- were received by the accused from the complainants. The possession of the plot was not given to hem and power of attorney was got executed in their favour. The accused persons further managed their tenant to live in the house in dispute and now they got the possession of the house in dispute.
(3.) The trial Court after going through the entire evidence convicted the petitioners as mentioned above. The findings of the trial Court have been affirmed by the lower Appellate Court.
