VED PAL Vs. STATE OF HARYANA

JUDGEMENT

(1.) THIS petition has been filed by petitioners Ved Pal, Isham Singh and Roshni under Section 482 Cr.P.C. for quashing of FIR No.247 dated 25.4.2010 (Annexure -P.1) registered on the complaint of Reshmacomplainant (respondent No.2) for the offences under Sections 406, 498 - A, 323 and 506 IPC at Police Station Karnal Sadar, District Karnal and all other subsequent proceedings arising therefrom on the basis of compromise dated 25.10.2013 (Annexure -P.2).

(2.) THE marriage between petitioner No.1 Ved Pal and respondent No.2 Reshma was solemnized on 24.2.2008 according to Hindu rites and ceremonies. Out of this wedlock one child was born on 31.7.2009. Due to different temperament, matrimonial dispute arose between the parties and the above FIR was got registered by complainantrespondent No.2 for the offences under Sections 406, 498 -A, 323 and 506 IPC against the petitioners. Now with the intervention of respectable persons, the parties have entered into a compromise dated 25.10.2013 (Annexure -P.2) and the husband and wife have decided to withdraw all the cases registered against each other.

(3.) ON 2.12.2013, learned Chief Judicial Magistrate, Karnal was directed to send a report with regard to the genuineness/validity or otherwise of the compromise (Annexure -P.2) after recording the statements of all the concerned parties.
