JUDGEMENT

(1.) The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.45 dated 2.2.2013 registered at Police Station Dinanagar, District Gurdaspur for the offence under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as 'the NDPS Act').

(2.) I have gone through the record and have heard learned counsel for the petitioner.

(3.) From the petitioner 520 Grams intoxicant powder has been recovered which falls under commercial quantity. Therefore, bar of Section 37 of the NDPS Act will apply in this case. In the facts and circumstances of the case, I do not find it to be a fit case where the present petitioner is entitled to the benefit of bail.
