JUDGEMENT

(1.) The petitioner has moved this petition under Sec. 439 of the Code of Criminal Procedure seeking regular bail.

(2.) The allegation is that the petitioner along with 4 other accused were found in possession of 7 bags of poppy husk weighing 35 kg. each. The petitioner was arrested on 23.06.2013, 7 days after the occurrence.

(3.) Learned counsel appearing for the petitioner would submit that the FIR does not reflect that anyone of the members of the police party could identify the petitioner herein, who allegedly gave a slip to the police party during the course of raid. Therefore, it is his submission that the petitioner, who was arrested without proper identification after 7 days from the date of occurrence, may be released on bail.
