JUDGEMENT

(1.) The tenant is in revision against the order of eviction passed by both the Courts below on an application filed by the landlord under Section 13 of the East Punjab Urban Rent Restriction Act, 1949 on the ground of personal necessity.

(2.) In brief, respondent no.1-landlord filed the eviction petition against the petitioner-tenant on the ground of non-payment of arrears of rent and personal necessity. Since the amount of rent has been tendered, therefore, the ground of non-payment of arrears of rent did not survive.

(3.) However, the learned Rent Controller framed the following issues on 07.04.1997:-
