(1.) This order will dispose of two criminal revisions bearing CRR Nos.3599 and 3600 of 2014.
(2.) Challenged in the present revisions is the order dated 01.11.2014 passed by learned Addl. Sessions Judge, Kurukshetra affirming the order dated 08.12.2010 passed by learned Judicial Magistrate 1st Class, Kurukshetra, vide which the present petitioners were convicted under Sections 408, 420 read with Section 120-B, 467, 468, 471 and sentenced by the order of sentence dated 09.12.2010 as under:
(3.) All the sentences were directed to run concurrently. However, the sentence of the present petitioners under Sections 408 and 420 read with Section 120-B IPC was modified by reducing the same to undergo rigorous imprisonment from two years to one year each and the appeal of the third accused Raj Pal was allowed by the learned Addl. Sessions Judge, Kurukshetra. The brief facts as necessary for the disposal of the present criminal revision petitions are that Mihan Singh, Asstt. Registrar, Cooperative Societies, Kurukshetra moved a complaint on 30.12.1997 before the Superintendent of Police, Kurukshetra, in which he alleged that during the audit for the period from 01.04.1995 to 31.03.1996 of the Ladwa Cooperative House Building Society Ltd., Ladwa conducted by Mam Raj, Sub Inspector (Audit) Coopertive Societies, Thanesar, it was found that a sum of Rs. 10,33,841.50/- was found embezzled by Ex. Secretary Suresh, Ex. Clerk Pardeep Kumar of the said Society (present revisionists) along with Smt. Poonam, Clerk of the Haryana State Cooperative Housing Ltd., Chandigarh. It was stated that as per the audit report, Rs. 10,45,241.50/- are shown to have been embezzled, out of which Jaswant Lal, Ex. Clerk of the said Society deposited a sum of Rs. 11,025/- on 23.06.1997 vide receipt No.765 and also deposited an amount of Rs. 380/- on the same day through transfer voucher with interest of Rs. 2,591/-. Therefore, the amount of embezzlement comes to Rs. 10,33,841.50/-. After the investigation, Clerk Poonam was found innocent and was not challaned.
