(1.) The appellant has preferred this appeal against the award dated 24.10.1994, whereby the claim petition filed by him was dismissed. The Tribunal had passed the award as there was no evidence whatsoever on record for the appellant.
(2.) Learned counsel for the appellant argued that evidence was closed by order of the court on 24.10.1994 and on that day itself, the order was passed. The appellant was present outside the court but by the time he could bring his counsel, the claim petition was dismissed.
(3.) It is pointed out in the award that despite availing four opportunities, the appellant did not lead any evidence. He also did not turn up on any of the dates fixed for evidence. Whether or not he was present outside the court was not the concern of the Tribunal. It also remained absolutely unexplained as to why the appellant did not make even his own statement during the time the matter remained pending for his evidence.
