JUDGEMENT

(1.) BY way of this order, I shall dispose of Criminal Appeal No. S -273 SB of 2000 titled "Rangoo Ram and others vs. State of Haryana" and Criminal Revision No. 660 of 2000 titled "Bhagwan Dass vs. Rangoo Ram and others" as these are the off shoot of judgment dated 23.2.2000 passed by the Additional Sessions Judge, Sirsa whereby Rangoo Ram and others have been convicted and sentenced for commission of offence punishable under Sections 323,326, 325 read with Section 34 of the Indian Penal Code(for short "IPC"), as detailed hereinbelow: -

(2.) THE facts of the case taken from the judgment of the trial Court reads as follows:

(3.) ON 1.1.1998, Bhagwan Dass complainant made a statement that on 31.12.1997, he along with his sons Amir Chand and Jaimal Ram was irrigating their fields through a tube well. His son Jaimal Ram was preparing a dol (ridge) in the field and Amir Chand was present near the tube well. At about 4.30 p.m., Rangoo Ram accused shouted that they should not be allowed to go and teach a lesson for filing an appeal in the Supreme Court against the order of acquittal under Section 307 IPC. In the meanwhile, Rangoo Ram, Mahender Ram, Baj Ram and Fatta Ram armed with gandasas came there. Mahender Ram came running towards the complainant and gave a gandasa blow from its reverse side on his back. Fatta, Rangoo Ram and Baj Ram also came near the complainant, made him to fall on the ground. Mahender Ram gave a blow of gandasa on his right leg. Rangoo Ram gave a blow of gandasa from its reverse side on his right leg. Mahender Ram gave a gandasa blow from its reverse side on his right leg. Fatta Ram gave a gandasa blow from its reverse side on his left knee. Baj Ram gave a blow with gandasa on his left wrist. Another blow of gandasa was given by Baj Ram which fell on his left forearm. Rangoo Ram gave another gandasa blow from its reverse side on his left thigh. When Amir Chand tried to rescue him, he was also inflicted injuries by the accused. Amir Chand ran towards his brother Jaimal Ram and both of them rescued the complainant from the accused. Previously, in the year 1991, Rangoo Ram etc. had inflicted injuries to his son Jaimal Ram and case under Section 307 IPC was registered against them. The accused in the said case were acquitted by the trial court and appeal against acquittal was dismissed by the High Court. Thereafter, the complainant and the State filed the appeal in the Supreme Court and the case has been remanded to the High Court. Accused had a grudge against the complainant as he had filed an appeal in the Supreme Court of India.
