JUDGEMENT

(1.) THIS petition under Section 439 Cr.P.C. has been filed by the petitioner for grant of regular bail in FIR No. 104 dated 17.5.2013 registered under Sections 376/120 -B IPC and Section 201 IPC (added later on) at Police Station Faridabad NIT. The FIR was registered on the statement of prosecutrix.

LEARNED counsel for the petitioner also submits and this fact is not disputed that the petitioner filed Habeas Corpus petition bearing CRWP -970 -2013 on 2.5.2013 and the present FIR was registered thereafter. The recovery of CD/video was not effected during investigation. It is contended for the State that the same were destroyed and that is why Section 201 IPC has been added.
