JUDGEMENT

(1.) PRAYER made in the petition is for grant of anticipatory bail to the petitioner in case FIR No. 20 dated 21.1.2014 under Sections 420 and 120 -B IPC registered at Police Station Jandiala Guru, District Amritsar. While issuing notice, this Court vide order dated

(2.) 4.2014 granted ad interim relief of anticipatory bail to the petitioner, subject to her joining the investigation. 2. On 7.5.2014 when the petition was taken up for consideration, learned counsel for the complainant brought to the notice of the Court that an amount of Rs.12,00,000/ - was received by the petitioner from the complainant through Harpreet Singh and another amount of Rs.8,00,000/ - through Kashmir Singh and Sukhraj Singh in the presence of Iqbal Singh. However, learned counsel for the petitioner, while referring to the agreement to sell dated 23.1.2014 (Annexure P -2) submitted that two days after the registration of the FIR, the husband of the petitioner had sold his land alongwith residential house in favour of the complainant (80% share) and Iqbal Singh and Tarsem Singh (10% share each) for a total consideration of Rs.1,50,00,000/ - and the said agreement itself bore the signatures of the complainant. At that stage, learned counsel for the complainant prayed for an adjournment for obtaining instructions in regard to the agreement to sell.

HAVING heard learned counsel for the parties and keeping in view that the petitioner had in all received an amount of Rs.20,00,000/ - from the complainant which amount she wanted to return to the complainant but has failed to do so, this Court is of the considered view that she does not deserve the concession of anticipatory bail. The petition is, therefore, dismissed.
