JUDGEMENT

(1.) THE petitioners approached this Court seeking protection to their life and liberty on the ground that they have performed the marriage against the wishes of parents of petitioner No. 1 -Roshini Jha, by stating that petitioner No. 1 is major.

(2.) IN paragraph No. 2 of the petition the date of birth of petitioner No. 1 was stated as 29.09.1994 and that of petitioner No. 2 - Bhushan Kumar as 21.06.1985. In support of this assertion, affidavit dated 10.4.2013 (Annexure P -1) of petitioner No. 1 stating her date of birth as 29.9.1994 was also attached. On the above representation of the petitioners, this Court had shown indulgence and when the matter was listed on April 12, 2013, notice of motion was issued and meanwhile respondents No. 4 to 6 were directed not to cause any physical harm to the petitioners.

(3.) ON 10.5.2013, respondents No. 4 and 5 were stated to be present in person. It was submitted that the date of birth of petitioner No. 1 is 28.9.1996 and she was still a minor. It was also submitted that parents and brother of petitioner No. 1 are worried about the whereabouts and welfare of petitioner No. 1.
