JUDGEMENT

(1.) This criminal revision petition has been filed against the order dated 18.8.2010, whereby the petitioners have been summoned on a application made under Section 319 Cr.P.C in FIR No. 93 registered under Section 306 IPC dated 22.7.2008, Police Station, Kurali.

(2.) The allegations of the complainant were that his sister Soma Begum who was married to one Bashir Mohammad had committed suicide on account of harassment for dowry. The marriage was solemnized about 10 years back and there were two children a son, Aman aged 9 years and a daughter about 7 years old from this marriage. As per the allegations in the FIR, Soma Begum was harassed by her sister-in-law, sister-in-law's daughter, mother-inlaw and husband for want of dowry. On account of the harassment caused to Soma Begum she had stayed with her parents for a period of about 8 years. Thereafter on 31.7.2001, a compromise was effected and she went back to her husband. Thereafter again a Panchayat was convened and her in-laws took the responsibility to treat Soma Begum well. Finally on 19.7.2008, she informed her brother that she was being harassed and beaten for the last three days by her husband, Bashir Mohammad, Sister-in-law Anvari and sister-in-law's daughter Babi. Threreafter, the neighbours of her sister gave a telephonic call and told him about the death of her sister Soma Begum. On reaching PGI, he saw the dead body of her sister with a severe swelling on her head. He also noticed a deep injury on her head. As per the complainant, Soma Begum was killed by Bashir Mohammad, Anvari and Babi.

(3.) Counsel for the petitioners while referring to the order Annexure P-2 has argued that the occurrence took place on 19.7.2008. Statements of Gulzar Mohd., father of the deceased, Niro mother of the deceased, Roshan son of Sadhu Khan and a joint statement of respectables was recorded explaining the true facts (Annexures P-8 and P-9). As per the deposition of Gulzar Mohd, Niro wife of Gulzar Mohd., Roshan Khan and some of the members of the locality, Soma Begum was married 10 years ago with Bashir Mohammad and she used to remain ill and was taking treatment from Government Hospital, Sector 16, Chandigarh. She consumed poisonous substance instead of medicine and thereafter Bashir Mohammad got her admitted in PGI, Chandigarh. They had no suspicion on anyone on account of her death.
