JUDGEMENT

(1.) PETITIONER has filed this petition seeking direction to respondent No. 3 to allow the petitioner to join his duty. Learned counsel for the petitioner has submitted that the petitioner was working as a Cane Clerk with respondent No. 3. Petitioner was appointed as Agriculture Assistant/Surveyor w.e.f. 03.04.1991 against a regular post. Although, petitioner performed his duty up to 01.11.1991 but he was not allowed to mark his presence nor was paid any salary in this regard.

(2.) LEARNED counsel for respondent No. 3 has submitted that the writ petition was maintainable against Cooperative Sugar Mill Limited. In support of his arguments, learned counsel has placed reliance on the decision of the Apex Court in General Manager, Kisan Sahkari Chini Mills Ltd., Sultanpur, U.P. v. Satrughan Nishad and Ors. : JT 2003(8) SC 235 wherein it was held as under: -
