JUDGEMENT

(1.) PRAYER in this application is for condonation of delay of 157 days in filing the appeal. Heard.

(2.) IN view of the grounds mentioned in the application which is duly supported by an affidavit, the same is allowed and the delay of 157 days in filing the appeal is hereby condoned. FAO -5617 -2014

(3.) LEARNED counsel has raised the sole issue that the owner and the driver of the offending vehicle were proceeded against ex parte during trial/inquiry before the learned Motor Accident Claims Tribunal, therefore, the route permit and the driving licence of the driver of the offending vehicle could not be brought on record and as such, there was no evidence before the learned Tribunal to hold that the offending vehicle was being plied by a licensed driver on the permitted route.
