(1.) PARDEEP Goyal, Harsh Goyal and Manoj Aggarwal -petitioners have filed this petition under Section 482 Cr.P.C. for quashing of FIR No.549 dated 30.11.2012 (Annexure -P.1) registered for the offences under Sections 354, 506 and 34 IPC at Police Station Sector 39, Chandigarh and all other subsequent proceedings arising therefrom, on the basis of compromise dated 2.5.2013 (Annexure -P.2).

COMPLAINANT -respondent No.2 Manju Sood, Principal, Aanchal International School, Chandigarh got registered above FIR on the allegations that the petitioners tried to enter their school premises by depicting themselves as software salesmen. On asking of the guard to show him the identity cards, they pushed aside and ran inside the school. On hearing the commotion, teachers in the adjoining classes came out and tried to stop them, but they succeeded to enter the office of the Director S.K. Lal and started pushing the Director and also threatened to kill him. They also abused and slapped the complainant. Manoj Aggarwal suggested to Harsh Goyal that they should take the complainant and important documents from the office outside the school. Harsh Goyal and Pardeep Goyal were members of the Governing Body of the school, but they had given resignation from the membership in the year 2011. Thereafter, they tampered with the record of the Registrar of Societies, Chandigarh and were trying to become owners of the school in order to get undue benefit for themselves while causing great loss to them.
(3.) ON 8.1.2014, learned Chief Judicial Magistrate, Chandigarh was directed to send a report with regard to the genuineness/validity or otherwise of the compromise (Annexure -P.2), which he has sent vide letter dated 22.1.2014, wherein statements of complainant Manju Sood and accused -petitioners have been recorded. He has verified that the compromise entered into between the parties is without any pressure or fear. The complainant has made her statement without any fear, pressure and at her own free will and stated that she has no objection if above said FIR is quashed.
