JUDGEMENT

(1.) THIS petition has been filed by petitioners Sukhwinder Singh, Jaswinder Singh, Jasbir Kaur and Fateh Jang Singh under Section 482 Cr.P.C. for quashing of FIR No.116 dated 19.10.2008 (Annexure -P.1) registered for the offences under Sections 406, 498 -A and 34 IPC at Police Station I.A. Saha, District Ambala and all other subsequent proceedings arising therefrom on the basis of compromise dated 25.5.2013 (Annexure - P.2).

(2.) THE marriage between petitioner No.1 Sukhwinder Singh and complainant -respondent No.2 Jasbir Kaur was solemnized on 5.12.2004 according to Sikh rites and customs. Due to temperamental differences, matrimonial dispute arose between the parties and FIR No.116 dated 19.10.2008 was got registered by complainant -respondent No.2 for the offences under Sections 406, 498 -A and 34 IPC against the petitioners. Now with the intervention of respectable of 'biradari' and their well wishers, the parties have entered into a compromise dated 25.5.2013 (Annexure -P.2) and the husband and wife have decided to seek dissolution of their marriage by mutual consent by filing petition under Section 13 -B of Hindu Marriage Act.

(3.) ON 11.12.2013, learned Chief Judicial Magistrate, Ambala was directed to send a report with regard to the genuineness/validity or otherwise of the compromise (Annexure -P.2) after recording the statements of all the concerned parties.
