JUDGEMENT

(1.) THIS appeal has been filed by the appellants -claimants against the award dated 09.05.1991 passed by Motor Accident Claims Tribunal, Hisar on account of death of Shri Ram, aged about 40 years who died in a road side accident on 28.06.1990.

(2.) THE Tribunal assessed the income at Rs. 1200/ - P.M. and after deducting 2/3rd dependency comes to Rs. 800/ - P.M and applied the multiplier of 16. The Tribunal has awarded total compensation Rs. 1,53,600/ - along with interest @ 12% P.A. from the date of filing of the present claim petition till the realization.

(3.) LEARNED counsel for the appellants has argued that in the present case there were six dependents excluding the father and therefore, deduction of 1/3rd is highly excessive. I accept this argument and order deduction at 20%
