JUDGEMENT

(1.) BY this revision petition, the petitioner has assailed the judgment and order dated 27.03.2003 recorded by the Sessions Judge, Hisar who found him guilty for the offence punishable under Section 392 -394 of Indian Penal Code.

(2.) THE case set up by the prosecution was that on 22.10.1992 at 12:30 P.M., when Sheela Rani complainant was returning home and was near her house, a man came from the opposite side and asked her to remove her earings. He threatened her and slapped her and tore the earing from the ear. The left ear of complainant was cut. Sheela raised alarm. The accused was apprehended by Ajit and Anil Kumar while attempting to flee. The passersby assisted Ajit and Anil Kumar and the accused grappled with them and in this process he fell down and sustained injuries. Initially the accused disclosed his name as Balbir son of Hari Ram. On being taken to the police station, he revealed his true name as Zile Singh son of Kishori Lal.

(3.) THE earings were recovered and handed over to the police. A recovery memo was prepared which was signed by Zile Singh accused. The FIR was registered on the complaint of Sheela Rani. The complainant was got medico -legally examined.
