JUDGEMENT

(1.) THE petitioner impugns the order dated 27.09.2013 (Annexure P -5) passed by the Land Acquisition Collector -cum -DRO, Kaithal, rejecting his application under Section 28 -A of the Land Acquisition Act, 1894, on the ground that the application was time -barred.

(2.) ADMITTEDLY , the Reference Court passed the Award on 17.07.2010 against which the Regular First Appeal was decided by this Court on 01.05.2012. The petitioner moved the application under Section 28 -A of the Land Acquisition Act, 1894 on 14.02.2011. In no circumstances the said application is said to have been moved within the limitation period keeping in view the principles laid down by the Hon'ble Supreme Court in Popat Bahiru Govardhali etc. versus Special Land Acquisition Officer and another, : 2013 (10) SCALE, 371.

(3.) ORDERED accordingly.
