JUDGEMENT

(1.) KARAMJIT Kaur (complainant) has filed this appeal under Section 372 Cr.P.C. against the judgment dated 16.08.2013 passed by the court of Additional Sessions Judge, Sangrur, vide which accused Bhupinder Kaur (respondent No.2 herein) was acquitted of the charges framed against her under Sections 120 -B and 302 IPC.

(2.) THOUGH there is a delay of 119 days in filing this appeal and the appellant has filed application (Crl. Misc. No.5060 of 2014 ) for condoning the delay, yet we have heard learned counsel for the appellant on merit, and gone through the impugned judgment.

(3.) AS per prosecution case, on 12.05.2011, when S.I. Bikramjit Singh was present at bus -stand village Dehleez Kalan in connection with search operations, Karamjit Kaur (complainant) along with her son Gurpal Singh approached him and made a statement to the effect that her husband Avtar Singh was a truck driver and he used to go to village Maholi Kalan and return back home daily. On 11.05.2011 at about 8.00 a.m., her husband went to Ahmedgarh on his bicycle. At about 5.52 p.m., he informed her son Gurpal Singh on mobile phone that he was not coming back due to work. Thereafter, no phone call was received from her husband. Then complainant and her son Gurpal Singh went to Ahemadgarh in search of Avtar Singh. When they were coming from village Maherna Khurd to village Dehleez Kalan, they saw the gathering of some persons. A dead body was lying in the nearby fields. The complainant went near the dead body and found it to be of her husband Avtar Singh. The dead body had head injury with sharp edged weapon and blood was coming out from his mouth. Karamjit Kaur (complainant) stated that her husband had been murdered by some unidentified person(s). The police then conducted the investigation. The photographs of the place of occurrence were got clicked. Postmortem examination was got done. The police made inquiry from the drivers in Truck Union, Ahmedgarh.
