JUDGEMENT

(1.) KARTAR Singh, who was a prosecution witness in the trial conducted against the four accused, respondents No.2 to 5 herein, for the offence under Sections 341/307/323/325/34 IPC, has filed the instant criminal appeal under Section 372 Cr.P.C. against the judgment of acquittal of respondents passed by the trial Court.

(2.) AS per the prosecution, the aforesaid case was registered on 21.9.2010 on the statement of Basant Singh (PW) injured. As per the said statement, on 20.9.2010 at about 11:30 a.m., complainant Basant Singh and appellant Kartar Singh were travelling in a bus to go to Tapa Mandi when the occurrence had taken place. As per the version given by Basant Singh, four accused came in Tata Sumo and Gypsy car and stopped their bus by putting their vehicles in front thereof and caused injuries to Basant Singh.

(3.) THE said occurrence was witnessed by complainant Basant Singh who was injured, Kartar Singh and one Niranjan Singh (PW).
