(1.) HEARD .

(2.) PETITIONERS were arraigned as accused in Criminal complaint No. 155/1 of 06.10.2006 wherein Court of learned Judicial Magistrate, 1st Class, Jalandhar (for short -'the trial Court') vide order dated 16.09.2011, had discharged them by observing as under: -

LEARNED counsel for the petitioner has vehemently argued that learned trial Court has scanned the entire evidence available on record, has come to a definite conclusion that no offence is made out against the petitioners and that being so, order of revisional Court cannot be sustained because the revisional Court has brushed aside the well established position of law that in the absence of a prime facie case, charge against accused cannot be framed.
