JUDGEMENT

(1.) Complainant Lachhman Singh has filed this appeal aggrieved by the acquittal recorded by the trial Court.

(2.) The case of the prosecution is that Joginder Singh and Teja Singh spotted the deceased along with the accused. Thereafter, the deceased went missing. Pursuant to the enquiry made by the complainant and his wife, only the cycle of the deceased could be recovered. Suspecting that the accused had committed the murder, a case under Section 302 IPC read with Section 201 of the IPC was registered against the accused.

The learned trial Court, having adverted to the evidence, adduced by the prosecution, came to a conclusion that the prosecution witnesses themselves had entertained a doubt as to whether Harpreet Singh was alive or dead. The trial Court also noted down the fact that no motive had been alleged against the accused for the murder of Harpreet Singh. Referring to the evidence of Teja Singh and Joginder Singh who allegedly witnessed the deceased along with the accused, the trial Court made a pertinent comment that their evidence also was found to be contradictory. In the absence of any other material to establish the case of the prosecution, the trial Court ultimately recorded acquittal.
