JUDGEMENT

(1.) ALL the appeals are connected and arise out of the same accident that took place on 15.04.1990. All the three deceased persons were going in a maruti car after attending some marriage. A "trolla" which was loaded with cement and other articles and being driven by the first respondent dashed against the car when all three of them travelling in the maruti car died at the spot. The Tribunal has assessed compensation in all these cases and the appeals are for enhancement.

(2.) IN the appeal in FAO No.2302 of 1996, the deceased was a male, aged 36 years. He was said to be a Hardware Merchant. The claimants were widow, two minor children and parents. His income was said to be Rs.32,000/ - per year. I will reappraise the compensation on the scales laid down by the decision of the Supreme Court in Sarla Verma Versus Delhi Transport Corporation and another -2009(6) SCC 121 as regards the prospect of increase, deduction and the multiplier and set out as follows: - <IMG>JUDGEMENT_177_TLP&H0_2014.jpg</IMG> <IMG>JUDGEMENT_177_TLP&H0_20141.jpg</IMG>

(3.) THE amount in excess over what has been awarded already by the Tribunal will attract interest at 7.5% from the date of petition till date of payment.
